Other reasons people use N244

Most N244 applications are not about keeping a home. People also use it, for example, to ask the court to set aside a judgment, change a court order or extend a deadline. Our helper does not fill in the form for these.

What the form is

application notice (the official word you may see on your papers)

This means a form asking the court to make a decision in a case that is already going on.

order (the official word you may see on your papers)

This means a decision of the court that people must follow.

You fill it in, sign it, and give it to the court with any fee. The court then decides what to do, sometimes at a hearing. Sending the form does not mean the court has agreed.

What it is used for

N244 is used for many different requests in civil cases, for example asking the court to change or pause an order. The fee is different depending on what you ask for.

In a mortgage repossession case, it can be used to ask the court to suspend a warrant of possession, which means pausing the eviction. GOV.UK’s guide to delaying an eviction tells people to use form N244 for this.

What is on the form

The current version (06.22) has five pages:

  • Page 1: the court and case details, and questions 1 to 9 about you, your request and any hearing.
  • Page 2: question 10, the information you rely on, with a large box for evidence.
  • Page 3: question 11, any support or adjustments you or a witness need.
  • Page 4: the statement of truth, which you sign by hand.
  • Page 5: the address and contact details where documents should be sent.

statement of truth (the official word you may see on your papers)

This means your signed confirmation that the facts are true.

Where to get it

The form is free to download from GOV.UK. There is also a large-print version, official notes on how to fill it in and a Welsh-language page.

N244 form example (fictional)

This is a made-up example. The people, court and numbers are not real.

It shows the kind of thing that goes in the main boxes when someone asks to pause a mortgage eviction. Do not copy the wording: your form must use your own facts and your own words.

Name of court
County Court at Exampletown (copied from the top of the court papers)
Claim number
X00EX000 (a made-up claim number; yours is printed near the top of your papers)
Claimant and defendant
Claimant: Example Lending Ltd. Defendant: Sam Sample.
Question 3: what order are you asking the court to make and why?
That the warrant of possession is suspended (paused), with a short reason. The full story goes in question 10.
Question 5: how do you want the application dealt with?
At a hearing, at short notice, before the eviction date shown on the notice.
Question 10: the information you rely on
The person’s own account: what changed, what they can now pay each month, and the papers they will bring, such as payslips or bank statements.
Statement of truth
Signed by hand and dated on the printed form.

Our free helper asks for each of these in turn and shows where to find them on your papers.
